1. Purpose

These general terms of sale and use govern access to the Zaid Express marketplace and every sale concluded on it. Placing an order implies full acceptance of this document in the version in force on the day of the order.

They apply to buyers and registered sellers alike, each as regards their own role.

2. Operator

Zaid Express is operated by a company incorporated under Moroccan law and duly registered in Morocco. Its full legal identifiers appear in the legal notice and are provided on request.

3. Definitions

  • Marketplace: the Zaid Express website, connecting independent sellers with buyers.
  • Seller: any registered and approved professional offering products on the marketplace.
  • Buyer: any person placing an order on the site.
  • Physical product: tangible goods shipped to the buyer.
  • Digital product: file or licence key delivered electronically, with no physical medium.

4. Role of the marketplace

Zaid Express acts as a technical intermediary. The sales contract is concluded directly between the buyer and the seller whose product appears on the order. The marketplace neither owns nor holds the products offered.

A single order may combine items from several sellers. In that case it gives rise to as many separate sales contracts as there are sellers, each bearing its own delivery, warranty and after-sales obligations.

The marketplace is responsible for the proper functioning of the site, the security of payments passing through it, and the handling of complaints under article 17.

5. Registration and account

An account is required to place an order. The buyer undertakes to provide accurate information and keep it up to date, in particular the delivery address and telephone number on which correct fulfilment depends.

Credentials are personal and confidential. Any order placed from an account is deemed to come from its holder, unless fraudulent use is reported without delay.

The marketplace may suspend an account in the event of breach of this document, repeated unclaimed orders without reason, or conduct harmful to sellers or other users.

6. Products and information

Each seller is responsible for the information relating to its products: name, description, photographs, price, availability and characteristics, and warrants that it is accurate and compliant with applicable regulations.

Photographs are illustrative. Minor differences in colour or presentation do not constitute a lack of conformity.

Products are offered within the limits of the stock declared by the seller. If stock runs out after the order, the buyer is informed and refunded the corresponding amount if already paid.

7. Prices

Prices are shown in Moroccan dirhams (MAD), inclusive of tax where the seller is liable for it. They exclude delivery charges, which are shown separately before the order is confirmed.

The site may display prices converted into other currencies for guidance only. The contractual amount and the amount charged remain in dirhams, whatever display is chosen.

The applicable price is the one displayed when the order is confirmed. A later change has no effect on orders already placed.

8. Ordering

An order follows these steps: item selection, delivery address, payment method, review of the summary, then confirmation. Confirmation constitutes acceptance of the price and of this document.

A confirmation email summarises the order. It evidences registration of the order, not final acceptance by the seller, who has a reasonable period to confirm or decline it, in particular where stock is unavailable.

The site's records are evidence between the parties as to orders placed, unless proved otherwise.

9. Payment

Only the payment methods displayed at the time of ordering may be used. As of today:

  • Cash on delivery — payment is made to the courier when the parcel is handed over, within the limit shown at checkout.
  • Bank transfer — bank details are provided after the order. The order is prepared only once funds have actually been received; the buyer must quote the order reference on the transfer instruction.
  • Money transfer at an approved counter — instructions are provided after the order. The order is prepared once receipt of the transfer is confirmed.

Card payment will be offered later, through the secure platform of the Centre Monétique Interbancaire (CMI). When it goes live, card details will be entered on CMI servers and will never pass through the site. This article will be updated accordingly.

A deposit may be requested to confirm certain orders. Its amount is shown before confirmation and is deducted from the balance due on delivery.

Non-payment entitles cancellation of the order.

10. Delivery

Delivery charges and times are set by each seller according to destination and displayed before the order is confirmed. A basket combining several sellers may give rise to several deliveries and several shipping charges.

Announced times run from the seller's confirmation of the order. They are indicative and exclude public holidays.

The buyer must check the condition of the parcel on receipt and report any damage or shortage to the courier and the seller as soon as possible.

Repeated absence at the stated address or refusal to accept delivery without legitimate reason may result in return costs being charged to the buyer.

11. Withdrawal and returns

Under Law No. 31-08 on consumer protection, a consumer buyer has seven (7) days from receipt of the product to withdraw, without having to give reasons or pay a penalty.

The product must be returned in its original condition, complete, unused and in its packaging. Return costs are borne by the buyer, except where the seller is at fault or the product does not conform.

Refunds are made as soon as possible after receipt and inspection of the returned product, by the same means as payment unless otherwise agreed.

Exclusions from the right of withdrawal

The right of withdrawal does not apply to:

  • digital products whose download or licence activation has begun, the buyer expressly waiving that right on accessing the file;
  • made-to-measure or personalised products;
  • perishable products, and those unsealed after delivery which cannot be returned for hygiene or health reasons.

12. Warranties

The seller remains bound by the statutory warranties provided for by the Dahir forming the Code of Obligations and Contracts and by Law No. 31-08, in particular the warranty of conformity and the warranty against latent defects.

A commercial warranty may be offered in addition by the seller or manufacturer. It in no way restricts the statutory warranties.

Warranty claims are addressed to the seller, through the site's messaging or the complaint form.

13. Digital products and licences

Digital products are made available after payment is confirmed, by download or by delivery of a licence key.

The buyer obtains a personal, non-exclusive right of use. Unless the seller states otherwise, resale, sharing, public provision and any reproduction beyond personal use are prohibited.

The number of downloads and the availability period may be limited; these limits are shown on the product page.

14. Seller obligations

The seller undertakes to:

  • be duly registered and up to date with its legal and tax obligations;
  • offer only lawful products which it is entitled to sell;
  • describe its products accurately and keep its stock up to date;
  • ship within the announced times and track its orders;
  • handle complaints and honour the warranties owed to its buyers;
  • issue the accounting documents required by regulation.

Breach of these obligations may lead to suspension or closure of the shop, without prejudice to orders in progress, which remain due.

15. Commission and payouts

The marketplace deducts a commission on each sale; the rate is shown to the seller in its dashboard and may vary by product type.

Sums collected on the seller's behalf are paid over after deduction of commission, at the agreed frequency. Amounts relating to cancelled, refunded or unpaid orders give rise to no payout.

16. Customer reviews

Only buyers who have actually purchased the product may leave a review. Reviews bind their authors.

The marketplace reserves the right to refuse or remove any review that is unlawful, abusive, unrelated to the product, or manifestly posted in bad faith.

17. Complaints and disputes

Complaints are first addressed to the seller concerned, through the site's messaging or the complaint form, which keeps a record.

Failing a solution within a reasonable period, the buyer may refer the matter to the marketplace, which acts as mediator and may, as appropriate, refund the sums collected.

The parties favour amicable settlement. Failing that, disputes fall within the jurisdiction of the competent courts of Casablanca.

18. Personal data

Data collected is necessary for order processing, delivery, after-sales service and compliance with accounting obligations. It is processed in accordance with Law No. 09-08 on the protection of individuals with regard to the processing of personal data.

Data strictly necessary to fulfil the order — name, address, telephone — is passed to the seller concerned and, where applicable, to the carrier.

The buyer has rights of access, rectification and objection, exercised at contact@zaidexpress.ma. The privacy policy sets out the processing carried out.

19. Intellectual property

The brand, domain name, visual identity, site structure and its own content are protected. Reproduction without authorisation is prohibited.

Visuals and descriptions uploaded by sellers remain their property; they grant the marketplace the right to display and use them to promote the products concerned.

20. Liability

The marketplace cannot be held liable for non-performance attributable to the seller, the buyer, a carrier, or to force majeure.

It uses reasonable means to ensure the site's availability, without being able to guarantee uninterrupted operation, in particular during maintenance.

21. Amendment

This document may be amended at any time. The version applicable to an order is the one in force on the day it is confirmed. Substantial changes are notified to registered sellers before they take effect.

22. Governing law

This document is governed by Moroccan law, in particular the Dahir forming the Code of Obligations and Contracts, Law No. 31-08 on consumer protection, Law No. 53-05 on the electronic exchange of legal data and Law No. 09-08 on personal data protection.
